Lawsuit Alleges Senator's Service On State Pension Commission Is Unconstitutional

A lawsuit alleges a state senator's service on the Oklahoma State Pension Commission is unconstitutional.

The lawsuit was filed Thursday against the commission, its chairman, state Treasurer Ken Miller, and Republican Sen. Rick Brinkley of Owasso, an appointed member of the commission.

The lawsuit was filed by Oklahoma City attorney Jerry Fent, who has a history of challenging legislative actions. It asks the Oklahoma Supreme Court to decide the case.

The commission is a division of the executive branch of state government. The lawsuit alleges that Brinkley's service on it violates the state constitution's separation of powers doctrine because Brinkley is a member of the legislative branch of government.

The Supreme Court set an April 7 hearing in the case. Brinkley did not immediately return a telephone call seeking comment.
