A federal judge says a recently released report into the execution of Clayton Lockett should be included in the record of a lawsuit filed by 21 Oklahoma death row inmates seeking to stop their own executions.
U.S. District Judge Stephen Friot filed the order on Tuesday. It directs prison officials to file the state Department of Public Safety investigation in the record of the inmates' lawsuit.
A hearing in the case is set for Sept. 18. Friot says the report will help him decide motions in the lawsuit.
Lockett writhed and moaned before he was declared dead 43 minutes after his execution began April 29. The report blamed problems with Lockett's lethal injection on poor placement of an intravenous line.
